1. Acceptance of these terms

By using Hazard Clarity (the "service"), you agree to these Terms of Service. If you don't agree, don't use the service.

2. What this service is — and isn't

Hazard Clarity provides an educational, plain-language summary of publicly available federal hazard data for an address you enter. It is not, and should not be relied on as: an insurance quote, a coverage recommendation, an engineering opinion, a flood determination for lending purposes, or a guarantee of insurability. It does not replace consulting a licensed insurance professional.

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to submit contact information requesting an insurance review through this service.

4. No professional advice

Nothing on this service constitutes insurance, legal, financial, or engineering advice. For decisions about coverage, purchase, or risk mitigation, consult a licensed insurance professional or other appropriate expert.

5. Accuracy of data

Hazard data is sourced from public federal and government datasets queried at the time of your search. These sources can be incomplete, delayed, temporarily unavailable, or subsequently revised. We make no warranty as to accuracy, completeness, or currency, and encourage you to independently verify any result using the links we provide back to each agency's own public tool.

6. Acceptable use

You agree not to: use automated means to scrape or systematically query this service in a way that abuses the free public APIs it depends on; submit false or fraudulent contact information; attempt to access the agency, history, or analytics dashboards without authorization; or use the service in violation of applicable law.

7. Intellectual property

The service's software, design, and original text are owned by Hazard Clarity. Underlying hazard data belongs to the respective issuing government agencies and is generally in the public domain.

8. Third-party links and services

This service links to third-party tools (FEMA, ASCE, USFS, and others) and, if enabled, uses Mapbox for address suggestions and confirmed alternate location matches. Location estimates are not surveys or verification of a building, parcel boundary or apartment. Those services are governed by their own terms and privacy policies.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAZARD CLARITY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold Hazard Clarity harmless from any claim arising from your misuse of the service or violation of these terms.

12. Termination

We may suspend or terminate access to the service at any time, for any reason, including suspected misuse.

13. Changes to these terms

We may update these terms as the service changes. Continued use after a change constitutes acceptance of the updated terms.

14. Governing law and dispute resolution

These terms are governed by applicable law. Any dispute relating to the service will be handled in a court of competent jurisdiction unless applicable law requires otherwise.
